Note for App Store: Many apps use Apple’s standard EULA and only host a separate Terms of Use / Privacy Policy. If you set a Custom EULA in App Store Connect, you can paste or link this document. Otherwise, Apple’s standard EULA applies and this file can serve as supplemental terms together with your Terms of Use.
This End User License Agreement (“Agreement”) is between you (“User”) and SY apps (“Licensor”) for the Lumira software application (“Licensed Application”).
Licensor grants User a non-transferable license to use the Licensed Application on any Apple-branded products that User owns or controls, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Licensor is solely responsible for providing maintenance and support for the Licensed Application, as specified in the App Store listing or as required under applicable law. Apple has no obligation to furnish maintenance or support services for the Licensed Application.
Licensor is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of failure of the Licensed Application to conform to a valid warranty, User may notify Apple, and Apple may refund the purchase price for the Licensed Application to User; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Licensed Application.
Licensor, not Apple, is responsible for addressing any claims by User or any third party relating to the Licensed Application or User’s possession and use of it, including product liability claims, regulatory compliance failures, and consumer protection claims.
In the event of any third-party claim that the Licensed Application infringes that third party’s intellectual property rights, Licensor, not Apple, will be solely responsible for investigation, defense, settlement, and discharge of any such claim.
User represents and warrants that User is not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that User is not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms may apply when the Licensed Application uses third-party services (e.g. advertising networks). See the Privacy Policy for more information.
This license is effective until terminated. User’s rights will terminate automatically without notice if User fails to comply with any term of this Agreement.
Except as required by law, the Licensed Application is provided “as is” without warranty of any kind.
Replace SY apps and support email. Align with Apple’s EULA requirements if using as Custom EULA in App Store Connect.
